Crane Accident Kills Four

Four workers were killed and seven more were injured on Friday when a huge industrial crane collapsed at the LyondellBasell refinery in southeast Houston. All of those who were killed or injured were contract employees at the refinery, located at 12000 Lawndale near Allen Genoa. Two of the dead were identified as Marion Odom of the Highlands and John Henry of Dayton. The crane belonged to Deep South Crane & Rigging.

Dell Sued for Not Paying Overtime

As many as 5,000 Dell Inc. call center workers could be eligible for a class-action lawsuit certified last week by a federal judge in Oregon. According to the lawsuit, the computer company did not properly pay domestic call center workers for overtime or compensate them for training or job time preparation. AAJ Releases Report on Worst Insurers

The American Association for Justice released a report last week listing the nation’s worst insurance companies for consumers. Allstate topped the list of insurers who refuse to pay just claims, employ hardball tactics against policyholders, reward executives with extravagant salaries, and raise premiums while hoarding excessive profits, followed by Unum and AIG. The report was compiled using information from court documents, SEC and FBI records, state insurance department investigations and complaints, nationwide news accounts, and testimony of former insurance agents and adjusters. Patients Suing Over Digitek

Patients who took the recalled heart medication Digitek have filed at least nine lawsuits in New Jersey against Actavis Totowa LLL and its parent company Actavis Group, claiming that the drug was dangerous and defective. Actavis initiated a nationwide recall of the drug earlier this year after it was discovered that some tablets may have contained twice the active ingredient of the drug. Study Links Prozac and Other Antidepressants to GI Bleeding

A new study reports that a commonly used class of antidepressants may be linked to bleeding in the upper gastrointestinal tract. The study also noted that chances of bleeding were significantly increased when antidepressants were taken with nonsteroidal anti-inflammatory painkillers. The study, published in the the July issue of Archives of General Psychiatry, is the latest of several reports tying the selective serotonin reuptake inhibitors family, which includes Prozac, Paxil and Zoloft, to such bleeding. City Pays $5.5 Million to Police Shooting Victim

The city of Coronado, Calif. has agreed to pay $5.5 million to settle a lawsuit filed by a former NFL player who was shot by an off-duty police officer. Steve Foley was shot in the back of his left knee and hip after the officer pulled him over on suspicion that he was driving under the influence. $2 Million Settlement in Train Accident Lawsuit

San Francisco has agreed to pay $2 million to settle a lawsuit filed by a woman who was struck by a city-run train earlier this year. According to the lawsuit, the driver of the N-Judah train was negligent in the accident that resulted in the amputation of part of Dina Gryn’s leg. $19.6 Million Awarded for Brain Damaged Baby

A New York hospital and its doctors were responsible for injuries suffered by an infant and his mother during a 1998 delivery, a jury has concluded. According to an attorney for the family, the botched birthing procedure left the child brain damaged and the mother mutilated. Jurors awarded a total of $19.6 million to the mother and child. Kroger Sued Over E. Coli

An Ohio woman filed a lawsuit Monday against grocery store chain Kroger Co. alleging that she was sickened by ground beef bought at one of their stores. According to the lawsuit Amanda Adam was hospitalized with an E. coli-related illness after eating hamburger patties purchased at a Dublin store on June 4. The lawsuit seeks at least $25,000 in damages. AP, Forbes 06/30/2008

Wal-Mart Workers Recover $6.5 Million

A Minnesota judge on Tuesday ordered Wal-Mart to pay $6.5 million in compensatory damages for violating state labor laws more than 2 million times. District Judge Robert King found the nation’s largest retailer willfully denied employees rest and meal breaks and forced employees to work off-the-clock. $18 Million Awarded in Trucking Accident Case

A Colorado couple should receive more than $18 million in damages for injuries they suffered in a 2006 crash with a tractor-trailer, a Wyoming jury has ruled. Jurors found that Werner Enterprises Inc. and the driver of the tractor-trailer bore responsibility for the crash that left Peter D. Brohpy in a wheelchair and unable to speak.
