Warnings Regarding Some Diet Pills

The FDA is warning against some diet pills that are being sold on the Internet. Some of them contain sibutramine and/or phenolphthalein, both of which have serious health risks such as heart attacks, heart palpitations, stroke and cancer. The products are listed as follows:

Broker Overtime Suits Will Go Forward

A suit against JPMorgan Chase filed by brokers will go forward. The overtime suit accuses the company of improperly denying overtime pay and commissions. The suit was brought under the Fair Labor Standards Act (FLSA) and New York law. The suit seeks to recover overtime pay and attorney's fees. Reuters 12/9/08

Wal-Mart Workers Recover $54 Million in Off-The-Clock Case

Wal-Mart will pay more than $54 million to workers in Minnesota. The workers alleged Wal-Mart forced them to take shortened breaks and labor off the clock. The settlement will reclaim wages for about 100,000 current and former workers. Staff, Seattle Times 12/09/2008.

Family Dollar to pay $35.6 million to employees after violation of Fair Labor Standards Act

The AP (12/17) reported, "A federal appeals court has upheld a $35.6 million judgment against Family Dollars Stores Inc., which was sued by employees denied overtime pay because they were classified as store managers." The jury "ruled in 2006 that Family Dollar violated the Fair Labor Standards Act and awarded back pay to 1,424 employees who routinely worked 60 to 70 hours a week with duties that included mopping floors, unloading trucks, stocking shelves and running cash registers."

Alter Boy Receives $3.6 Million in Molestation Case

A jury in Vermont awarded a former alter boy$3.6 million in damages because he was molested by a priest in the 1970s. The plaintiff claimed the diocese was to blame because it hired the priest knowing he had previously molested multiple children. 12/17/08 Burlington Free Press

$23.5 Million Awarded in Trucking Case

A man who was injured by a truck driver who was on methamphetamines was awarded $23.5 million. Jurors found that Swift Transportation was mostly responsible for the injuries that left the plaintiff with spinal cord injuries. Ron Sylvester, Wichita Eagle 12/02/2008

$48 Million Awarded to Railroad Worker

Union Pacific has been ordered to pay one of its workers $48 million for injuries sustained on the job. Due to the company's alleged negligence, the plaintiff was left paraplegic following an accident that occurred while he was working in the course and scope of his employment. The employee had filed suit under the Federal Employers Liability Act (FELA).
