DePuy Hip Recall Lawsuit Update
Texas courts may be central site for DePuy Pinnacle Legislation
Lawsuits are being filed nationwide against another of DePuy's hip implant systems - the Pinnacle hip implant. The Pinnacle hip system has been reported to cause similar problems as the ASR hip systems - early failure rates and revision surgery.
There are 37 complaints filed in 18 different district courts over the Pinnacle hip systems, but that number is expected to go up. In order to consolidate the lawsuits being filed nationwide, Johnson & Johnson and DePuy Orthopaedics agree that cases filed throughout U.S courts should be transferred to one judge.
One of the first plaintiffs to file a DePuy Pinnacle hip lawsuit filed a motion requesting that complaints be centralized in the U.S. District Court for the Southern District of Texas before Judge Rosenthal. DePuy suggested another location for the litigation - the Northern District of Texas, before Chief Judge Sidney Fitzwater.
Multidistrict litigation, or MDL, is common in cases where a large number of product liability lawsuits are filed over one product. Coordinating litigation is designed to help reach a resolution without having to go to trial for each case. Similar consolidation was ordered for the DePuy ASR lawsuits - those hip systems were recalled in August 2010. DePuy ASR hip implant lawsuits are part of an MDL in the U.S. District Court for the Northern District of Ohio, before Judge David A. Katz.
You may have heard about the r ecalled DePuy ASR hip implants earlier this year. DePuy's Pinnacle hip implant system is alleged to cause the same issues as the ASR hip system. The DePuy Pinnacle system was introduced before the ASR hip system and it contains a similar metal-on-metal design. Both devices have been alleged to shed metal particles into the body as pieces rub against each other.
