Pharmacy lawsuits in Texas and nationwide

Novo Nordisk pays $25 million to settle lawsuit for falsely marketing hemophilia treatment

Novo Nordisk A/S settled a lawsuit with the Department of Justice this month over allegations that the company marketed its hemophilia treatment, NovoSeven, for unapproved uses to both civilian and military physicians. The drugmaker marketed NovoSeven for uses including trauma usage. This led the Department of Defense to buy NovoSeven for troops wounded in Iraq and Afghanistan.

The company said that it will pay the U.S. government $25 million to resolve a Department of Justice investigation over allegations that it improperly promoted NovoSeven. The drug was widely used in Afghanistan and was eventually incorporated into Army protocols and Novo Nordisk began to use this as a selling point to physicians in the US for use in trauma units.

Whistleblowers who reported the Denmark-based company will get over $3.5 million, the Department of Justice said. The company also addressed allegations that U.S. sales representatives paid pharmacists at the drugstore chain Rite Aid to recommend Novolin and Novolog, used to treat diabetes.

Drug manufacturer and pharmacy errors can be dangerous and, in some cases, they can have fatal consequences. Pharmaceutical companies invest millions into marketing their drugs and many companies put products on the market before conducting proper product testing. Our firm has represented numerous clients who have suffered because of improper product testing. We have filed claims against virtually every major pharmacy in the country, and David W. Hodges and Galvin B. Kennedy are Board Certified in Personal Injury Trial Law by the Texas Board of Specialization.
