Texting While Driving Accidents in Houston

Houston Personal Injury Lawyer

With the increased use of smart phones throughout the country, there have been a huge number of serious accidents that are the result of negligent drivers who engage in texting while driving. This dangerous activity has been on the rise in recent years, and many innocent people suffer serious injuries when a driver distracted by their phone and text messaging hits them from behind, completely unaware of the road conditions, other drivers, or the necessity to come to an immediate stop. They also are prone to swerve out of lanes and sideswipe other vehicles, causing multi-vehicle accidents and dangerous vehicle rollovers or other serious accidents. If you or a loved one has been injured by a driver who was engaged in texting while driving, you have the right to pursue compensation for damages. Not only has the negligent driver endangered all those who share the road, they are violating the law when they failed to exercise reasonable care for the safety of others. There is no message that is more important than the keeping your attention on the road or highway. Our legal team at Kennedy Hodges, LLP is prepared to assist the injured or their families to pursue adequate compensation in any accident caused by a driver who was using their phone and not paying enough attention to the environment to avoid an accident.

Distracted Drivers: Texting While Driving

In Texas, two new laws have been passed restricting teens from using cell phones while driving, and a prohibition against using handheld electronic devices in school crossing zones. Current state law does not allow those under 18 to use any form of wireless communication devices while driving. School bus operators are restricted from the use of handheld electronic phones or other devices while they have children in the vehicle. Although more restrictions regarding distracted driving have been passed by both the senate and house, the expanded statutes were vetoed.

Currently, all cell phones must be hands-free when in school crossing zones. No matter what laws are enacted by state lawmakers, there are those that continue to engage in this negligent act, as is proven in other states in which laws restrict texting while driving, and these accidents continue to increase. Those who endanger the lives of others must be held accountable in any accident that they caused through distracted driving. Our firm can access cell phone records to support our case for compensation. We take every necessary step to pursue fair and full compensation for our injured clients.
