Houston Injury Claims: FAQ
Have you been wrongfully injured? If so, it is not unlikely that you have considerable questions about the process that you are facing. Most people are not well-versed in personal injury law and without the assistance of a knowledgeable attorney can find themselves unsure of where to turn. It is for this reason that we encourage you to contact a member of our firm at Kennedy Hodges, LLP. At our firm, we are dedicated to providing our clients with reliable legal assistance and helping them to truly understand the details of what they are facing. In an effort to follow through on this, we have both asked and answered some of the most common questions about the process.
Common Questions in Personal Injury Cases
How do I choose an injury lawyer for my case?
Experience and results matter. At Kennedy Hodges, LLP, we have a reputation for achieving high value settlements in all types of injury cases. We are proud to have been named Super Lawyers, Houston's Top Lawyer & Professional on the fast track by H Texas magazine, and Galvin B. Kennedy and David W. Hodges are both Board Certified by the Texas Board of Legal Specialization in personal injury trial law. There is no substitute for experience and proven results.
How much could I get in a settlement?
Each case has unique circumstances and should be evaluated by a Houston personal injury lawyer from our firm as early as possible after the injury, illness or loss of life. With a careful documentation of every type of damage, you stand a much higher chance of getting the amount you deserve. If you try to manage this on your own, or are dealing directly with an insurance company, you are at a great disadvantage and may be offered a settlement far, far lower than our firm could recover for you. We can evaluate you case and advise you what to expect in a settlement, and how long we expect the process to take to finally resolve.
Are there time limits in filing a claim?
Under state law, the time in which to file a claim for personal injury is within two years from the date of the injury. In wrongful death claims, you are restricted to two years from the date of death. In both medical malpractice and product liability claims, you also have two years from the date of the injury. It is important that all evidence that could support your case is preserved, and it is advised that you contact our firm as soon as possible so nothing that could be significant to your claim is lost.
How is the attorney paid in a personal injury case?
If we don't win, you don't pay. Our personal commitment to our clients and their cases allows us to provide legal counsel based upon the final recovery we achieve on their behalf. We take a small percentage of the final settlement, which is usually far more than any individual could have expected to negotiate on their own. This arrangement allows you to engage our services without having to outlay cash when you are already in a difficult financial situation with medical bills and other obligations.
What if I am unable to come to the office?
We can come to you at home, at your office, or in the hospital or other treatment facility. We recognize that there is not always a convenient place to meet following and injury, but we don't believe that should limit you from reaching compassionate and experienced legal assistance. If you would like to learn more about how we can help or the different ways that we can help, give us a call and we can schedule the best time and place for meeting and discuss your case in-person.
