It’s not a good time for medical equipment company C.R. Bard right now. As you may have already heard, hundreds of patients who have received the company’s inferior vena cava (IVC) filters are taking legal action after the blood clot filters have caused major medical issues.

Many of the Recovery IVC filter recipients allege that the filters, which are designed to collect blood clots and prevent them from traveling into the lungs, are causing more damage than good. Some of the filters are changing position and moving into other parts of the body. Other patients have experienced filter fractures in which pieces break off and pierce vital organs. These problems have resulted in patients needing emergency open-heart surgeries that enduring long recovery times. Unfortunately, some patients have even died because of the filters failing.

Lawsuits Against Bard Continue to Rise

According to a recent report, as of October 15, 2015, there are 56 lawsuits sitting in multi-district litigation—a federal legal procedure that is designed to speed up the process of handling complex legal cases—against Bard. In September of 2015, there were only 50, which means six additional people were added to the lawsuits in just one month. Some cases are still pending in state and federal courts.

The three filter models that are at the center of the IVC filter lawsuits are the Bard Recovery, Bard G2, and Bard G2 Express filter. The victims are suing for negligence, failure to warn of potential dangers, manufacturing and design defects, negligent misrepresentation, and breach of implied warranty.
