Misclassified Railroad Worker Denied Proper Overtime

The attorneys of Kennedy Hodges, L.L.P. successfully represented a railroad construction worker paid straight time for overtime by a large railroad construction corporation. The employer misclassified its railroad construction employees as exempt pursuant to inapplicable law affecting a limited number of employees in the railroad industry.

The defendant paid 100% of the overtime owed, an equal amount as liquidated damages (penalties), and virtually all of the plaintiff's attorneys' fees incurred.
