For patients who suffered adverse side effects after taking popular blood pressure medication Benicar, a lawsuit may be the best course of action to obtain compensation from the drug’s manufacturer. Many victims accuse the manufacturer of failing to adequately warn patients about the potential side effects associated with the use of this drug. These side effects may include diarrhea, vomiting, weight loss, and villous atrophy. Recently, some of these lawsuits have been combined into multidistrict litigation.

4 Differences Between Multidistrict Litigation and Class Action Lawsuits Involving Benicar Use

Multi-district litigation is often beneficial to plaintiffs because pre-trial proceedings can be centralized before one judge. As a result, the discovery process can be coordinated more easily and cases can more efficiently be prepared for trial. Generally, multidistrict litigation is appropriate where there are many common questions of fact and law among the various cases filed by individuals who suffered harm as a result of taking a particular drug. There are important differences between multidistrict litigation involving the use of Benicar and a Benicar class action lawsuit, however. Some of these differences are outlined below:

  1. In a class action suit, all claims are tried through a class representative.
  2. In multidistrict litigation, however, each plaintiff still has the burden of proving that his or her injuries were caused by the use of Benicar.
  3. In multidistrict litigation, each plaintiff must demonstrate the amount of damages that they are entitled to as a result of the Benicar use.
  4. With multidistrict litigation the circumstances surrounding the use of the medication and the resulting harmful side effects are different in each case. As a result, the claims are not judged based on the same set of facts.
